The Capital Development Authority (CDA) has issued a strict show cause notice to Bahria Town (Pvt) Ltd, directing the developer to hand over 487.92 kanals of public amenity land, roads, and parking areas within 10 days. The authority warned that failure to comply could lead to strong legal and administrative action.
Background and Legal Grounds
According to the notice, Bahria Town has repeatedly ignored multiple reminders issued throughout 2025. Under the CDA Ordinance 1960, ICT Zoning Regulation 1992, and the Private Scheme Regulations 2023, all developers are legally required to transfer public-use land to CDA without delay.

CDA also referenced several key Islamabad High Court rulings from 2017, 2018, and 2025, which instructed authorities to strictly enforce zoning laws and barred developers from withholding or altering land allocated for community use.
Officials said that the layout plans for Bahria Paradise Commercial Schemes I–IV were approved in August 2023. Together, the schemes cover 893.91 kanals, and their approval was conditional on transferring all public building plots, parking spaces, and road networks to CDA free of cost.
Land Yet to Be Transferred
Despite clear regulations, CDA noted that Bahria Town has not transferred:
- 306.9 kanals of amenity plots
- 181.02 kanals of roads and parking areas
- Graveyard land required under Clause 34(24) of planning regulations
The authority added that Bahria Town failed to submit compliance reports, display boards, and updated satellite/drone imagery—requirements needed to confirm that public-use spaces are properly marked, protected, and not encroached upon.
CDA Warns of Major Action
If Bahria Town fails to comply within the 10-day deadline, CDA has warned of a wide range of punitive measures, including:
- Requesting NAB or FIA investigations
- Blocking public access to the private scheme
- Suspending all future building plan approvals
- Selling mortgaged plots to recover the value of non-transferred land
- Sealing relevant offices
- Demolishing unauthorized structures, with full cost recovery

The notice states that the developer has been granted a final opportunity to appear for a personal hearing within the given timeframe.
According to CDA officials, these actions are aimed at protecting public rights, ensuring the proper use of land reserved for community facilities, and enforcing long-standing regulations designed to prevent the misuse of public spaces.
